1. General Provisions

1.1. These Terms and Conditions of Sale of the online store (hereinafter referred to as the "Terms and Conditions") constitute a binding document for the Buyer and the Seller, establishing the rights, obligations and responsibilities of the Parties when the Buyer purchases products from the online store.

1.2. The Seller reserves the right to amend, supplement or update these Terms and Conditions at any time. Any changes to the Terms and Conditions shall take effect from the moment they are published on the online store, unless otherwise provided by law. The version of the Terms and Conditions in force at the time the order is placed shall apply to the Buyer.

2. Conclusion of the Purchase Agreement

2.1. The purchase agreement between the Buyer and the Seller shall be deemed concluded when the Buyer completes and submits an order in the online store and makes payment using the selected payment method, having previously familiarised themselves with these Terms and Conditions.

2.2. A separate purchase agreement shall be deemed concluded for each order placed by the Buyer.

3. Rights of the Seller

3.1. In the event of significant circumstances, the Seller reserves the right to temporarily or permanently suspend the operation of the online store without prior notice to the Buyer, where necessary for technical, security, maintenance or other objective reasons.

3.2. If the Buyer attempts to interfere with the operation, stability or security of the online store or breaches their obligations, the Seller reserves the right to restrict or suspend the Buyer's access to the online store.

4. Obligations of the Seller

4.1. The Seller undertakes to provide the Buyer with access to the services of the online store in accordance with the procedures established in these Terms and Conditions.

4.2. The Seller undertakes to deliver the products purchased by the Buyer using the delivery method selected by the Buyer, in accordance with the delivery conditions and timeframes specified in the online store.

4.3. If the ordered products cannot be delivered due to objective circumstances beyond the Seller's control, the Seller has the right to inform the Buyer and offer an alternative product, if available. If the Buyer declines the alternative product or no alternative can be offered, the Seller shall refund the amounts paid by the Buyer.

4.4. If the Buyer lawfully withdraws from a distance purchase agreement, the Seller shall refund all amounts paid by the Buyer, including the standard delivery costs paid by the Buyer, no later than 14 days from the date of receiving the Buyer's notification of withdrawal, except in cases provided for by law.

4.5. The Seller has the right to withhold the refund until the product has been returned to the Seller or the Buyer has provided proof that the product has been sent back to the Seller, whichever occurs first.

5. Rights of the Buyer

5.1. The Buyer has the right to purchase products from the online store in accordance with these Terms and Conditions and the applicable laws of the Republic of Lithuania.

5.2. The Buyer, acting as a consumer, has the right to withdraw from a distance purchase agreement within 14 days of receiving the product without providing a reason, except in cases provided for by the laws of the Republic of Lithuania.

5.3. To exercise the right of withdrawal, the Buyer must clearly inform the Seller of their decision to withdraw from the agreement within 14 days of receiving the product. The Buyer must send or hand over the product to the Seller no later than 14 days from the date of submitting the notification of withdrawal.

5.4. The Buyer has the right to inspect and examine the product to the extent necessary to establish its nature, characteristics and functioning. If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, the Buyer may be held responsible for any resulting reduction in the product's value.

5.5. The right of withdrawal does not apply in the circumstances specified in the Civil Code, including cases where products cannot be returned due to their nature or for hygiene reasons if their protective seal or packaging has been opened or damaged after delivery, where such exceptions are provided for by law.

6. Obligations of the Buyer

6.1. The Buyer is obliged to pay for the purchased products and accept their delivery in accordance with these Terms and Conditions.

6.2. If the Buyer refuses to accept the ordered products without a valid reason, the Seller has the right to request reimbursement of reasonable expenses incurred as a result of such refusal, provided that this does not conflict with applicable law.

6.3. Upon receiving the parcel, the Buyer is advised to inspect its external condition. If the parcel is damaged, the Buyer should note the damage in the delivery documents or inform the delivery service provider and the Seller.

6.4. By using the online store, the Buyer confirms that they have familiarised themselves with these Terms and Conditions and undertake to comply with them.

7. Product Prices

7.1. Product prices in the online store are displayed in euros and, where applicable, include VAT as prescribed by the laws of the Republic of Lithuania.

7.2. Upon confirmation of the order, a delivery fee shall be added to the total price of the products, where applicable, unless the Buyer has selected a free delivery option.

8. Ordering and Payment

8.1. The Buyer selects the desired products in the online store and adds them to the shopping cart. Once the shopping cart has been completed, the Buyer provides the information necessary to fulfil the order, including their first name, last name, delivery address, telephone number and any other required information.

8.2. Before placing an order, the Buyer confirms that they have familiarised themselves with these Terms and Conditions and submits the order.

8.3. Payments can be made using the online banking services of Swedbank, SEB, Luminor, Šiaulių bankas, Medicinos bankas, Citadele and Revolut, as well as Visa and Mastercard payment cards. All payments are processed in euros.

8.4. Payments are processed through the Montonio payment platform.

9. Product Delivery

9.1. When ordering products, the Buyer must provide an accurate delivery address or select another delivery method offered by the online store.

9.2. The Buyer must ensure that the products can be received at the address provided or at the selected parcel pickup point.

9.3. The Seller shall deliver the products to the Buyer within the timeframes specified in the online store and/or in the order. If no specific delivery timeframe is indicated, the products shall be delivered within the timeframes prescribed by applicable law.

9.4. The characteristics of all products offered for sale are specified in their respective product descriptions. Due to the technical characteristics of the screen of the device used by the Buyer, the colour or other visual characteristics of the product may differ slightly from those displayed in the online store.

9.5. If the Buyer lawfully withdraws from a distance purchase agreement, the Seller shall refund all amounts paid by the Buyer, including standard delivery costs, except in cases provided for by law. If the Buyer has selected a delivery method that is more expensive than the standard delivery option offered by the Seller, the additional cost of the selected delivery method shall not be refunded.

10. Product Returns

10.1. The Buyer, acting as a consumer, has the right to withdraw from a distance purchase agreement within 14 days of receiving the product without providing a reason, except in cases specified in the Civil Code.

10.2. To exercise the right of withdrawal, the Buyer must clearly inform the Seller of their decision to withdraw from the agreement within 14 days of receiving the product by contacting the Seller at info@martlet.lt or through another method specified by the Seller.

10.3. The Buyer must send or hand over the product to the Seller without undue delay and no later than 14 days from the date of submitting the notification of withdrawal.

10.4. The returned product must be properly packaged to prevent damage during transportation. The Buyer shall be responsible for any reduction in the product's value resulting from handling or use beyond what is necessary to establish its nature, characteristics and functioning.

10.5. The original packaging, labels, protective films and other product components should be retained whenever possible. However, the absence of these elements alone does not automatically deprive the consumer of the right to withdraw from a distance contract, unless otherwise provided by law.

10.6. The Buyer shall bear the direct costs of returning the product, except where otherwise provided by law or where the Seller has expressly stated that it will cover these costs.

10.7. If a defective, delivery-damaged or incorrect product is returned, the return costs shall be borne by the Seller where required by law.

10.8. Upon receiving the Buyer's notification of withdrawal from the agreement, the Seller shall refund all amounts paid by the Buyer, including standard delivery costs, no later than 14 days from the date of receiving the notification. The Seller has the right to withhold the refund until the product has been returned or the Buyer has provided proof that the product has been sent back.

10.9. Refunds shall be issued using the same payment method used by the Buyer for the original transaction, unless the Buyer expressly agrees to another method and does not incur any additional costs as a result.

10.10. The return and exchange of defective products, as well as other claims made by the Buyer regarding product quality, shall be handled in accordance with the laws of the Republic of Lithuania.

11. Final Provisions

11.1. These Terms and Conditions have been prepared in accordance with the laws of the Republic of Lithuania.

11.2. These Terms and Conditions and the relationship between the Buyer and the Seller shall be governed by the laws of the Republic of Lithuania.

11.3. All disputes shall first be resolved through negotiations. If an agreement cannot be reached, the consumer has the right to contact the competent consumer protection authorities or other dispute resolution bodies in accordance with the procedures established by the laws of the Republic of Lithuania.

11.4. The Seller shall not be liable for failure to perform or improper performance of its obligations if such failure is caused by force majeure circumstances as defined under the laws of the Republic of Lithuania.

11.5. These Terms and Conditions do not limit the rights granted to the Buyer under the laws of the Republic of Lithuania and the European Union.
